  1. Our commercial policy

1.1

The Seller carries out its e-commerce activity exclusively towards its end users who have reached the age of majority and who are "consumers".

1.2

When we speak of "consumer" we refer to any natural person who acts on boninistore.com with purposes not related to their commercial, entrepreneurial or professional activity, possibly carried out. If you are not a "consumer", we invite you to refrain from concluding commercial transactions on boninistore.com.

1.3

In consideration of its commercial policy, the Seller reserves the right not to accept proposals for purchase orders from parties other than the "consumer" or in any case proposals for purchase orders that do not comply with its commercial policy, such as, for example, proposals for orders for which there is a report, or suspicion, of fraudulent or illegal activities. In such cases, the Seller will notify the user of the non-acceptance of the order proposal.

All order proposals sent to the Seller and returns made by users must also correspond to normal consumption needs. The Seller therefore monitors the number of order proposals sent and returns made.

1.4

These General Conditions of Sale exclusively regulate the sending of purchase order proposals for products available on boninistore.com by the user and the acceptance of the same by the Seller.

1.5

The General Conditions of Sale do not regulate the provision of services or the sale of products by parties other than the Seller that are present on boninistore.com through links, banners or other hyperlinks. We advise you, before placing orders and purchasing products and services from parties other than the Seller, to check their conditions of sale, because the Seller is not responsible for the provision of services by third parties other than the Seller or for the conclusion of e-commerce transactions between users of boninistore.com and third parties.

 

  1. Information aimed at the conclusion of the contract with the Seller pursuant to Legislative Decree 9 April 2003, n. 70

2.1

To conclude the purchase contract for one or more products on boninistore.com, you must send an electronic purchase order proposal to the Seller by filling out the form available on boninistore.com and following the relevant instructions.

2.2

Before transmitting the order proposal, we remind youto carefully read the General Conditions of Sale and the Information on the Right ofWithdrawal,to print a copy through the print command and to store or reproduce a copy for your personaluse. In accordance with Article 51, paragraph 7, of Legislative Decree 6 September 2005, n. 206 (the "Consumer Code"), before transmitting the order proposal, we will provide you with a summary of the commercial and contractual conditions that will apply to your proposal for the purchase order of the products and a summary of the information on the essential characteristics of each product ordered with its price (including all applicable taxes or duties), the means of payment that you can use to purchase each product, the methods of delivery of the products purchased, shipping and delivery costs; as well as the references, the geographical address and the contact methods of the Seller and the date by which the Seller, once accepted your order proposal, undertakes to deliver the goods. The Seller will also provide you with a summary of the conditions and methods for exercising your right of withdrawal. If applicable, you will be informed that, in case of withdrawal, you will have to bear the cost of returning the products. In any case, you will be reminded of the existence of the legal guarantee of conformity of the products and the possibility of using the platform for the alternative out-of-court resolution of disputes, accessible on the http://ec.europa.eu/odr website, made available by the European Commission.

2.3

On the confirmation page of the order proposal, which contains a reference to the General Conditions of Sale and the Information on the Right of Withdrawal, we will provide you with summary information about the essential characteristics of each product indicated in your order proposal, the price (including all applicable taxes or duties) and shipping costs (including any additional costs incurred by you for choosing a type of shipping and delivery different and/or faster than the standard one).

2.4

The transmission of the order proposal to the Seller constitutes a binding purchase proposal for the user. Before proceeding with the transmission of the order proposal, you will therefore be asked to identify and correct any errors in data entry.

2.5

Once you have submitted your order proposal, you will receive an automatic e-mail from the Seller to confirm receipt of your order proposal. The receipt of the aforementioned email does not constitute acceptance of your order proposal.

2.6

The contract is concluded when your order proposal is accepted by the Seller. The Seller will send you a second e-mail to confirm the acceptance of your order proposal and the shipment of the products. This email will also contain a copy of the General Conditions of Sale and the summary document on the Right of Withdrawal.

2.7

The order proposal sent to the Seller will be stored in our database for the period of time necessary to process the order proposals accepted by the Seller and in any case within the terms of the law. You can access your order proposal form by consulting the My Ordersection.

2.8

The language available to conclude the contract with the Seller is Italian.

2.9

The Seller may not accept your proposals for purchase orders that do not give sufficient guarantees of solvency or that are incomplete or incorrect or in case of unavailability of the products.

In these cases, we will inform you by e-mail that the contract is not concluded and that the Seller has not accepted your purchase order proposal specifying the reasons. If the products, presented on boninistore.com, are no longer available or for sale at the time of receipt or processing of your purchase order proposal, the Seller will notify you, promptly and in any case within thirty (30) days from the day following that on which you have sent your order proposal to the Seller, any unavailability of the products. If you have already paid the price for the products, the Seller will refund, without undue delay, what you have already anticipated and the sales contract will be considered terminated.

The Seller also reserves the right not to accept proposals for purchase orders in the cases referred to in paragraph 1.3 above.

2.10

We remind you that, with the electronic transmission of the order proposal, you unconditionally accept and undertake to observe, in relations with the Seller, these General Conditions of Sale. If you do not agree with some of the terms contained in the General Conditions of Sale, we invite you not to submit your order proposal for the purchase of products on boninistore.com.

2.11

By transmitting the order proposal you confirm that you also know and accept the additional information contained in boninistore.com, also referred to through links, including the General Conditions of Use and the Privacy Policy and the Information on theRightof Withdrawal.

  1. Guarantees and indication of product prices

3.1

The Seller sells only luxury branded and top quality products. These products are purchased directly from the Seller at fashion houses, manufacturers and retailers carefully selected for their strict quality controls.

3.2

The Seller does not sell used, irregular or inferior quality products to the corresponding standards offered on the market.

3.3

The essential characteristics of the products are presented on boninistore.com within each product sheet. The images and colors of the products presented on boninistore.com may not, however, correspond to the real ones due to the effect of the Internet browser and the monitor used.

3.4

Product prices may be subject to updates. Make sure of the final sale price before submitting the relevant order proposal. In the event that a recognizable error should be found in the indication - by Bonini Srl - of the price of a product or in the calculation of the amount requested in payment, Bonini Srl will not accept the order proposal and will contact the user in order to offer the opportunity to transmit the purchase order proposal of the product (s) at the correct price.

3.5

All products are equipped with an identification tag fixed with a disposable seal.

3.6

All products sold by Bonini Srl are covered by the legal warranty of twenty-four (24) months for defects of conformity, in accordance with applicable law. The lack of conformity of the product must be communicated to the Seller within two (2) months of its discovery. The lack of conformity can be communicated to the Seller by contacting Customer Service. In case of lack of conformity you have the right to request the repair or replacement of the product. In the event that the aforementioned remedies are not possible or are excessively burdensome, you will be entitled to a reduction in the price paid or to the termination of the sales contract, pursuant to art. 130 of the Consumer Code.

  1. Payments

4.1

For the payment of the price of the products and the related shipping and delivery costs you can follow one of the methods indicated in the order proposal form. Under no circumstances will you be charged costs higher than those actually incurred by the Seller, in relation to the payment instrument chosen by you.

4.2

In case of payment by credit card, the financial information (for example, the number of the credit / debit card or the date of its expiry) will be forwarded, via encrypted protocol, to Credem or other banks, which provide the related remote electronic payment services, without third parties being able, in any way, to have access to them. Furthermore, this information will never be used by the Seller except to complete the procedures relating to your purchase and to issue the relative refunds in the event of any returns of the products, following the exercise of your right of withdrawal, or if it is necessary to prevent or report to the police the commission of fraud on boninistore.com. The price for the purchase of the products and the shipping costs, as indicated in the order proposal, will be debited from your current account at the time of shipment of the purchased products.

5.1

Value vouchers are personalized codes that allow you to take advantage of a discount on purchases made on boninistore.com.

  1. Shipping and delivery of products

6.1

Shipping costs are €7.9 with UPS Standard and €18.9 with UPS Express Saver. The products will be shipped within 72 hours upon receipt of payment of the order.

  1. Right of withdrawal

8.1

In accordance with art. 52 of the Consumer Code, you have the right to withdraw from the contract concluded with the Seller, without any penalty and without specifying the reason, within fourteen (14) days, starting from the day of receipt of the products purchased on boninistore.com. In some specific cases, duly indicated in the Right of Withdrawal section, it will be possible to change the chosen garment with another.

8.2

In accordance with art. 54 of the Consumer Code, you can withdraw from the contract concluded with the Seller using, at your choice, one of the following methods:

  1. a) sending by post to the Seller of this Return Form,in accordance with the standard form pursuant to Article 49, paragraph 4, of the Consumer Code, to be completed in full;
  2. b) sending by post to the Seller another explicit declaration of your decision to withdraw from the contract.

Your declaration must be sent to the attention of Customer Service at the headquarters of Bonini Srl, Via 11 Maggio, 142, 91025 Marsala (TP). It is understood that, in such cases, it will be your burden to prove the correct and timely exercise of the right of withdrawal.

8.3

In accordance with art. 57 of the Consumer Code, once the withdrawal from the contract has been exercised, you must return the products to the Seller by delivering them to the courier for shipment within fourteen (14) days from when you have communicated to the Seller your decision to withdraw from the contract.

8.4

The only expenses at your expense are those of returning the products purchased, unless the Seller has expressly exempted you from these costs at the time of purchase and on the further condition that you use the shipper and the shipping methods indicated in the following paragraph.

8.5

The right of withdrawal - in addition to compliance with the terms and methods described in paragraphs 8.1, 8.2, 8.3 and 8.4 above - is intended to be exercised correctly if the following conditions are also fully met:

  1. the right of withdrawal must be regularly exercised within fourteen (14) days of receipt of the products;
  2. the products must not have been used, worn, washed;
  3. the identification tag must still be attached to the products with the disposable seal that is an integral part of the good;
  4. the products must be returned in their original packaging (if you want to return a kit, you must return all the items that compose it);
  5. the returned products must be delivered to the shipper within fourteen (14) days from when you have communicated to the Seller your decision to withdraw from the contract;
  6. the products must not be damaged.

Pursuant to art. 59 of the Consumer Code, the right of withdrawal is also excluded in the event that you have purchased tailor-made or personalized products or sealed goods that do not lend themselves to being returned for hygienic reasons or related to health protection and have been opened after delivery.

8.6

The Seller will carry out the necessary checks in order to verify the conformity of the returned products with the conditions and terms indicated in paragraph 8.5 above.

If the right of withdrawal is exercised following the methods and terms indicated above, the Seller will send you, by e-mail, the relative confirmation of acceptance of the products thus returned and to reimburse any sums already collected for the purchase of the products according to the methods and terms provided.

8.7

The sums will be refunded to you as soon as possible and, in any case, within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal, we will activate the refund procedures, once the correct execution of the terms and conditions indicated above has been verified.

8.8

If the methods and terms for exercising your right of withdrawal are not respected, referred to in letters a), e) and f) of paragraph 8.5 above or in the hypothesis referred to in art. 59 of the Consumer Code, you will not be entitled to a refund of the sums already paid to the Seller. The Seller will notify you by e-mail of the non-acceptance of your return. Within 14 days of receipt of the Seller's e-mail, you may choose to obtain, at your own expense, the products in the state in which they were returned to the Seller, notifying the Seller, in the manner that will be communicated to you. Otherwise, the Seller may retain the products, in addition to the sums already paid for their purchase.

If, on the other hand, the Seller's investigations show that the conditions referred to in letters b), c) and d) of paragraph 8.5 above are not met, you will not be entitled to a full refund of the sums already paid to the Seller. In accordance with art. 57, paragraph 2, of the Consumer Code, you will, in fact, be responsible for the decrease in value of the returned products, resulting from a use other than that necessary in order to allow you to ascertain the nature, characteristics and functioning of the products themselves. In this case, a percentage equal to the estimated decrease in value of the products will be deducted from the expected refund and in any case between 10 and 90 percent of the sums paid by you to the Seller for the purchase of the returned products, as specifically communicated to you, by e-mail, by the Seller. Within 14 days of sending the e-mail with which you will be notified of the sum deducted from the refund, you can choose to obtain, at your expense, the products in the state in which they were returned to the Seller, notifying the Seller himself, according to the methods that will be communicated to you. Otherwise, the Seller may retain the products and an amount corresponding to the percentage deducted from the refund.

The Seller assumes no responsibility in case of products returned by mistake or items forgotten in packages or returned products.

  1. Refund times and methods

9.1

Whatever the method of payment used by you, the refund due, in whole or in part, is activated by the Seller, as soon as possible and in any case within fourteen (14) days from the date on which the Seller became aware of the exercise of your right of withdrawal after verifying the correct execution of your right of withdrawal and verification of the returned products.

9.2

The Seller makes the refund using the same means of payment used by you for the purchase of the returned products, unless you have expressly agreed with the Seller to use a different means of payment and provided that you do not have to bear any additional costs as a result of the refund. If there is no correspondence between the recipient of the products indicated in the order proposal and the person who made the payment of the sums due for their purchase, the reimbursement of the sums, in case of exercise of the right of withdrawal, will be performed by the Seller, in any case, against those who made the payment.

9.3

We remind you that the value date of the re-credit is the same as the charge; as a result you will not suffer any loss in terms of bank interest.

11.1

Without prejudice to the application of the mandatory rules of European derivation to protect the consumer, the General Conditions of Sale are governed by Italian law and in particular by the Consumer Code and by Legislative Decree 9 April 2003, n. 70 ("Implementation of Directive 2000/31 / EC on certain legal aspects of information society services in the internal market, with particular reference to electronic commerce").

We also inform you that the European Commission provides a platform for alternative out-of-court dispute resolution, accessible on the website http://ec.europa.eu/odr.

11.4

For all disputes relating to the purchase and / or these General Conditions of Sale will be competent the Court of Marsala.

12.1

The General Conditions of Sale are modified from time to time by the Seller also in consideration of any regulatory changes. The new General Conditions of Sale will be effective from the date of publication on boninistore.com.
